Do you know the Kars4Kids jingle? If so, you are not alone. A California judge has now found that the same catchy simplicity that made the ad effective also made it deceptive.

In May, an Orange County Superior Court judge <a href="https://static1.squarespace.com/static/6330d829a70a2f54790593a1/t/6a013f8481b9ce28f7ba4975/1778466692646/kars4kids-california-false-advertising-final-judgment-5-2026.pdf" target="_blank" rel="noreferrer noopener">ordered</a> Kars4Kids to stop airing its well-known ads in California unless they include specific disclosures. The court found that the organization violated California’s false advertising and unfair competition laws.

The issue was not an outright false statement. Instead, the court focused on what the ads did not say. The ads feature young children and encourage donations to “help kids.” Yet evidence showed that proceeds largely fund programs – including initiatives for older teens and other programs outside California – tied to a related but different nonprofit.

The court concluded that this mismatch created a misleading impression for donors. As the judge put it, donors could not “un-donate” based on a later understanding of how funds were actually used. Going forward, the organization must either pull the ads or include an “explicit and audible disclosure” about its affiliation and how donations are used.

Kars4Kids disagrees with the judgment, including the presentation of the facts at trial, and has <a href="https://www.kars4kids.org/puterbaugh/index.php" target="_blank" rel="noreferrer noopener">announced plans to appeal</a>. Even with the appeal pending and final disposition unclear, this case is an important reminder: Material omissions can be just as risky as affirmative misstatements. Here, the court considered the overall impression of the ad, not just the literal claims. That is consistent with how the Federal Trade Commission (FTC), the National Advertising Division (NAD), state regulators and courts analyze advertising risk.

The ‘net impression’ standard is alive and well

It is not enough for every statement in your ad to be technically true. If the combination of visuals, tone and messaging leads consumers to a different (potentially inaccurate) takeaway, you have exposure. Here, the use of children ages 8-10, the name Kars4Kids and the absence of qualifying information that this was primarily a religiously affiliated organization that supports out-of-state initiatives created a specific expectation about beneficiaries, according to the plaintiff.

The court explicitly characterized the issue as “misleading by omission,” which aligns with broader FTC and NAD guidance that indicates: If a reasonable consumer would consider information material and the ad creates a contrary impression, failing to disclose that information can be deceptive.

In-house counsel will get the question “Can’t we just add all the detail on the website?” While more detail on the website may be helpful overall, the court determined it would not undo the alleged harm to consumers here, after they had made a donation. In this case, the plaintiff said he just called the number as instructed in the ad and is “not a computer person.” It’s important to think about the implication to consumers early in the purchase/donation flow.

Emotional advertising increases risk. This case is a classic example of the legal tension between emotional appeal and transparency. Simple, memorable messaging drives action. Yet that same simplicity increases the likelihood that key factors are left out. Courts are particularly skeptical when the ad relies on imagery depicting vulnerable subjects (e.g., think children or puppies) to prompt immediate consumer action.

A core tenet of advertising law is that a disclaimer can add to and help clarify a claim but cannot contradict it. In this case, the remedy handed down by the court is also instructive. The court did not say “add fine print.” It required clear, audible disclosure in the ad itself. Clear and conspicuous disclosure of material terms in close proximity to the ad or offer is the recommended approach to avoid potential consumer confusion.

Here’s a good checklist for in-house advertising counsel and business affairs teams when reviewing campaign materials:

Ask: What would a consumer think this claim means in real life?

If yes, you likely need disclosure or a revision to the claim itself.

Do not rely on your website as a safety net.

Ask: Is the information readily available?

Usually, you need to make material disclosures in the ad itself and point consumers to where they can learn more. Courts and regulators will not always treat after-the-fact disclosures as a cure.

Be careful with “category signaling” language.

Names, imagery and tone can send mixed signals and imply more than intended.

If your brand name itself implies a benefit, you likely need substantiation.

Look at the bigger picture.

Ask: How will the message realistically be received in the real world by the typical consumer?

Consider those implications and whether there are ways to mitigate risk with revised messaging.
